Opinions vary.   One professional may find fault with a procedure that another professional believes is perfectly adequate and within the standard of care.   When two professionals in a litigated matter differ in their opinions about whether or not a procedure meets the standard of care, then the resolution of that difference only occurs through negotiation, mediation or trial.

In some litigated cases it may be clear (and undisputed) that a mistake has occurred.  When this happensa resolution depends on the ability of the parties to come to an agreement on compensation.

Cases involving claims of medical or dental malpractice successfully mediated by Robert Jacobs include the following:

  • Claim that a dentist improperly dropped a dental tool into the mouth of a patient, causing injury
  • Claim that a physician improperly performed a knee tap
